Regulations passed in the Assembly

1. The Public Finance Management (Nairobi City County Assembly Mortgage Scheme Fund) Regulations

 The objective of the Regulations is to create a framework that regulates the use of monies set aside for the provision of an affordable Mortgage facility. The Regulations for the Mortgage facility for the Nairobi City County Assembly is necessitated by the need to provide an affordable mortgage facility for members and staff of the County Assembly. This is especially important in light of the rising cost of purchasing a single family home in relation to incomes, particularly in larger metropolitan areas in faster growing regions of the country such as Nairobi City. These Regulations will therefore guide the provision of financial assistance to members and employees to help purchase and finance their primary residences. The Regulations should create a framework that clearly outlines the procedures for accessing the loan, obligations with regard to a loan for both beneficiaries and management of the Fund set up for the same and matters incidental thereto.

 

2. The Public Finance Management (Nairobi City County Assembly Car Loan Scheme Fund) Regulations

The object and purpose of the Fund shall be to provide a loan scheme for the purchase of vehicles by members of the Scheme. It is envisaged that the Public Finance Management (Nairobi City County Assembly Car Loan Scheme Fund) Regulations will create a framework to guide the use of monies set aside for the provision of an affordable Car loan facility. The drafting of Regulations for the Car loan facility for the Nairobi County Assembly is necessitated by the need to provide an affordable vehicle loan facility for members and staff of the County Assembly. This is especially important in light of the rising cost of borrowing from external lenders, which remains out of reach for many. These Regulations will therefore guide the provision of financial assistance to members and employees to help finance their automobile purchases. The Regulations should create a framework that clearly outlines the procedures for accessing the loan, obligations with regard to a loan for both beneficiaries and management of the Fund set up for the same and matters incidental thereto.

3. The Nairobi City County petition to County Assembly (Procedure) Bill, 2014

The purpose of the Nairobi City County Petition to County Assembly (Procedure) Bill, 2014, is to provide for the procedure for petitioning the Assembly as contemplated under Section 15 (2) of the County Government Act, 2012. The right to petition the County Assembly is one of the rights of citizens enshrined in the Constitution and other Statutes, and it is the only way an individual can directly place grievances before the Assembly.

 

4. The Nairobi City County Environmental Management Authority Bill, 2014

To create a legislative framework that most effectively brings to effect the provisions of Schedule Four to the Constitution. The framework’s object is to prevent, stop or discontinue any act or omission deleterious to the environment. It is proposed that an Authority to oversee environmental management be established. The establishment of the Authority creates an institution singularly mandated to take measures to ensure conservation and protection of the environment within Nairobi City County.

 

5. The Nairobi City County Fire and Disaster Management Bill, 2014

Develop an effective, facilitating legislative and institutional framework for firefighting and disaster management within Nairobi City. Primarily, the Bill seeks to improve the safety and effectiveness of firefighting services in Nairobi. It must make provision for fire and rescue services, disaster preparedness and management, establish a Fire, Rescue Services and Disaster Management Directorate and its functions and powers, as well as employment by the Authority and the Directorate, education and training for firefighters and staff of the bodies created under the Bill, and other matters incidental to and for connected purposes.

 

6. The Nairobi City County Housing Corporation Bill, 2014

Develop a facilitating legislative and institutional framework in the housing sector within Nairobi City. The Bill must provide for loans and grants of public moneys for the construction of dwellings; to establish a housing fund and a housing board for these purposes; and for connected purposes. The legislative framework must effectively bring to effect the provisions of Schedule Four to the Constitution.

 

7. The Nairobi City County Plastic Materials Control Bill, 2014

The objective of the Bill is to create a framework that regulates the use of non-biodegradable polythene bags within Nairobi City County. Such a Bill must take in best practice in the ban and or regulation of plastic paper bags usage from across the region, for instance Rwanda, as well as other jurisdictions. Where a ban is necessary, it must chiefly target the use of non-compostable plastic carry-out bags at point of sale by retail establishments in the City of Nairobi. The Bill must also provide for education or awareness and incentives for shoppers to use re-usable bags at affected retail establishments across the City. It should create a framework that clearly outlines what types of materials are allowed for the manufacture of single-use shopping bags to be used within the city, and commensurate penalties for contravening the same.
